Approach

Mediation: There is no single approach suitable for all mediations. A good mediator must remain nimble, attuned to the unique dynamics of each case—as well as the evolving dynamics on the day of mediation. That said, there are three truths that frame Presidio ADR’s approach to all mediations:  

  • Preparation, Preparation, Preparation: Preparation by the mediator leads to better outcomes.

  • Guided Negotiation: A mediator who merely shuttles from room to room to convey numbers is rarely worth the money. The mediator must guide the negotiation.

  • We Keep the Dialogue Going Even When it Seems to Have Failed: Many cases that do not settle during the formal mediation session can and should settle thereafter, so follow-up by the mediator is a crucial part of the process.
